HOW IT WORKS

How Malaysian property stamp duty is calculated

Buying a home involves two stamp duties: transfer stamp duty on the memorandum of transfer (MOT), tiered on the price or market value, and stamp duty on the loan agreement. The calculator also adds an estimate of legal fees for the sale and purchase agreement and the loan.

Property value bandTransfer stamp duty
First RM100,0001%
RM100,001 – RM500,0002%
RM500,001 – RM1,000,0003%
Above RM1,000,0004%
Foreign buyer (residential, from 1 January 2026)8% flat
Loan agreement0.5% of loan amount

Legal fees

Legal fees for the sale and purchase agreement (SPA) and the loan agreement follow the Solicitors’ Remuneration Order 2023: 1.25% on the first RM500,000 (minimum RM500) and 1% above that, before SST and disbursements. Exemptions are not deducted automatically.

Frequently asked questions

How is property stamp duty calculated in Malaysia?

For Malaysian citizens and permanent residents, transfer stamp duty (MOT) is tiered on the higher of the price or market value: 1% on the first RM100,000, 2% on the next RM400,000, 3% on the next RM500,000 and 4% on any amount above RM1,000,000.

What is the stamp duty on a housing loan agreement?

The loan agreement is stamped at 0.5% of the loan amount.

How much is the stamp duty on a RM600,000 house?

RM12,000 in transfer stamp duty (RM1,000 + RM8,000 + RM3,000). With a RM540,000 loan, loan agreement stamp duty adds RM2,700. Including SPA and loan legal fees of about RM13,900, the total upfront cost is about RM28,600 before SST.

Do first-time buyers or foreigners pay different stamp duty?

Yes. Eligible first-time home buyers may qualify for government exemptions, which this calculator does not deduct. From 1 January 2026, foreign buyers pay a flat 8% transfer stamp duty on residential property instead of the 1%–4% tiers; choose Foreign buyer in the calculator. How much are the legal fees for buying a house in Malaysia?

Under the Solicitors’ Remuneration Order 2023, the SPA and loan agreement fees are each 1.25% on the first RM500,000 and 1% on the balance, before SST and disbursements. For a RM600,000 home with a RM540,000 loan that is about RM7,250 for the SPA and RM6,650 for the loan agreement.
